Can me and my boyfriend get married ever though he is still legally married

The short answer is no. If he is still legally married and then marries you, he's guilty of committing bigamy which is a crime. In addition, his remarriage to you would be invalid, or void. I would strongly recommend he take care of getting divorced before he marries you.
