Can one attorney represent both parties in an uncontested divorce.. No children or community property

Question

Can one attorney represent both parties in an uncontested divorce.. No children or community property

Answer

Personally, I think it is unethical. An attorney can represent both sides if both sides consent. I would assume that the attorney represents your spouse and I would ask my own attorney to look over the paper work before I sign it.

Having said that, I am often hired to draft paperwork for divorcing couples. But I make it clear that I represent one of them or the other but that I can explain it to both of them. I just can't give advice to the side I don't represent.

Good luck!!
