Question

I was incarcerated and during this time my ex boyfriend was granted sole custody because I was unable to be there, what do I need to do to contest or appeal this I cannot afford an attorney..

Answer

If it is more than 30 days after the entry of a final order of custody, you can no longer appeal. If it was a temporary order you can seek to modify it. Depending on how long you were incarcerated, it may have been appropriate at the time it was entered. If that it the case, then it is not easy to modify that order. Your release is not a basis for a change of circumstances which justifies a modification of the order. The road is not an easy one. The court will also consider why you were incarcerated.
