If the primary custody parent goes into a mental hospital can the non custodial parent get full custody
Answer
It depends. If the non-custodial parent only had supervised visitation, the Court will not allow that parent to have full custody. If the non-custodial parent had partial custody, such as, week-ends, they probably would get full custody, but in either event, it should be accomplished through the Family Division of the Court of Common Pleas and nothing should be assumed.
