Question

i live in the USA and a company in Canada who i am under contract is not paying me.

Can i settle in a small claims court in the USA even tho they are in Canada?

Answer

Generally, when it comes to Workman's Compensation, there are no foriegn companies. They are supposed to be insured, if they have employees working in Kansas. If you wish to settle with them, you should have an attorney look over the settlement documents. However, if it is a work related injury, your employer's attorney is not likely to allow them to settle all their liability through a small claims case.

Good luck
